SPECTRUM CHICAGO 2026

— OPEN CALL TERMS & CONDITIONS

These Terms and Conditions govern applications submitted to the ORAC Gallery — Spectrum Chicago 2026 Open Call.

By submitting an application and paying the application fee, the applicant confirms that they have read and accepted these Terms and Conditions.

1. ORGANISER

ORACART sp. z o.o. is responsible for the administration, selection process and organisation of the ORAC Gallery presentation associated with this Open Call.

The Open Call is organised independently by ORAC Gallery. Spectrum Chicago, THE MART and the fair organiser are not parties to the application agreement between the applicant and ORACART sp. z o.o.

 

2. PURPOSE OF THE OPEN CALL

ORAC Gallery is selecting an artist for the gallery’s presentation at Spectrum Chicago 2026, taking place at THE MART in Chicago, 7–10 October 2026.

The Open Call is intended for professional contemporary visual artists with a developed artistic practice, a distinct artistic language and works suitable for presentation within an international contemporary art fair context.

Submission of an application does not guarantee selection, exhibition, representation, sale of artworks or any future collaboration with ORAC Gallery.

 

3. APPLICATION DEADLINE AND ROLLING REVIEW

The application deadline is:

10 September 2026, 23:59 CEST

Applications are reviewed on a rolling basis.

ORAC Gallery reserves the right to close the Open Call before the stated deadline if an artist is selected and the curatorial requirements of the presentation have been fulfilled.

Applications submitted and paid before the Open Call is closed will remain eligible for review.

 

4. APPLICATION REQUIREMENTS

Applicants must submit the information and materials requested in the official application form, including, where applicable:

artist details, biography, artist statement, CV, portfolio, information concerning artistic practice and gallery representation, details and images of works proposed for Chicago, proposed retail prices, logistical information and information concerning the use of generative AI.

Applicants are responsible for ensuring that all information provided is accurate, current and complete.

ORAC Gallery may reject an application that is incomplete, contains materially inaccurate or misleading information, infringes third-party rights or does not provide sufficient material to conduct a professional assessment.

 

5. AUTHORSHIP AND RIGHTS

By submitting an application, the applicant confirms that:

  • they are the author of the submitted works or are fully authorised to submit them;

  • the submitted materials do not knowingly infringe third-party intellectual property rights;

  • information concerning authorship, medium, date, dimensions and use of generative AI is accurate to the best of their knowledge.

Copyright and all other intellectual property rights in submitted artworks remain with their respective rights holders.

The applicant grants ORAC Gallery a limited, non-exclusive right to access, copy and internally reproduce submitted materials solely to the extent reasonably necessary to administer and assess the application.

Submission of an application does not grant ORAC Gallery a general licence to publish, reproduce, sell or commercially exploit the applicant’s artworks.

Any broader use of materials relating to a selected artist, including promotional use, will be governed by arrangements made with that artist.

 

6. GENERATIVE AI DISCLOSURE

Applicants must accurately disclose whether generative AI was used in the creation of the submitted artworks and, where applicable, provide a brief explanation of its role.

Use of generative AI does not automatically disqualify an application.

ORAC Gallery may, however, take the nature, extent and artistic relevance of such use into account as part of its curatorial assessment.

Materially false or misleading disclosure regarding authorship or the use of generative AI may result in rejection or withdrawal of selection.

 

7. APPLICATION FEE

The application fee is:

€20

The application fee covers the administrative costs of the selection process, formal verification of the application and professional review of the submitted portfolio and materials.

The fee is charged for the application review service and is not a payment for exhibition space, gallery representation or selection.

Payment of the application fee does not increase or guarantee the applicant’s chances of selection.

An application is considered complete only when both:

  1. the application form has been successfully submitted; and

  2. the €20 application fee has been successfully paid and confirmed.

Applicants are responsible for any separate currency conversion or banking charges imposed by their own bank or payment provider.

8. COMMENCEMENT OF THE APPLICATION REVIEW SERVICE

Because the selection process is conducted on a rolling basis, ORAC Gallery may begin reviewing an application shortly after submission and payment.

The application form therefore requires the applicant to expressly request that ORAC Gallery begin providing the application review service before the expiry of any statutory withdrawal period that may apply.

Where the applicant is legally entitled to a statutory right of withdrawal, that right is governed by applicable consumer law.

If the applicant validly withdraws after expressly requesting that performance begin but before the review service has been fully performed, ORACART sp. z o.o. may be entitled, where permitted by applicable law, to retain or charge an amount proportionate to the service already provided.

Once the application review service has been fully performed, the applicant may lose the statutory right to withdraw where the conditions required by applicable law have been satisfied.

Nothing in these Terms limits any mandatory consumer rights that cannot lawfully be excluded or restricted.

 

9. REFUNDS

The application fee is not dependent on the outcome of the selection process.

A decision not to select an applicant does not in itself create a right to a refund.

Refunds will nevertheless be provided where required by applicable law.

ORAC Gallery may also correct confirmed duplicate payments or payments made as a result of a demonstrable technical error.

If ORAC Gallery cancels the Open Call without carrying out the application review service, affected applicants will be informed about the appropriate refund procedure.

 

10. SELECTION PROCESS

Applications are assessed by ORAC Gallery on the basis of professional, curatorial and practical considerations relevant to the Chicago presentation.

These may include, among other factors:

artistic quality, coherence and maturity of practice, distinctiveness of artistic language, suitability of the proposed works for the fair context, physical scale and installation requirements, transport feasibility, pricing, market context and overall compatibility with the ORAC Gallery presentation.

ORAC Gallery is not obliged to assign numerical scores or publish detailed selection criteria, rankings or deliberations.

ORAC Gallery may contact selected or shortlisted applicants for additional information.

ORAC Gallery does not guarantee individual written feedback to unsuccessful applicants.

 

11. SELECTION DOES NOT CREATE AUTOMATIC REPRESENTATION

Selection for Spectrum Chicago 2026 does not automatically constitute long-term gallery representation, agency, exclusivity, employment, partnership or any other continuing legal relationship with ORAC Gallery.

Any continuing cooperation will require separate agreement between the parties.

 

12. CONDITIONS FOR THE SELECTED ARTIST

The selected artist will be presented within ORAC Gallery’s official fair presentation.

The selected artist will not be charged:

  • a booth fee;

  • an exhibition fee;

  • a curatorial fee; or

  • a gallery representation fee

for participation in the ORAC Gallery Spectrum Chicago 2026 presentation.

Selection is conditional upon the artist and ORAC Gallery reaching timely agreement on the practical and commercial arrangements necessary to realise the presentation.

If such arrangements cannot reasonably be concluded, ORAC Gallery may withdraw the selection and invite another applicant.

 

13. TRANSPORT, PACKING, INSURANCE AND LOGISTICS

Packing, transport, customs, delivery, collection, insurance and other logistical arrangements concerning the selected works will be agreed individually with the selected artist.

Submission of an application does not mean that ORAC Gallery automatically assumes responsibility for all transport, customs, insurance or related costs.

No applicant should ship any artwork to ORAC Gallery or to the United States unless expressly instructed to do so in writing.

The selected artist must cooperate promptly with ORAC Gallery regarding dimensions, weights, packing, transport schedules, customs documentation and installation requirements.

 

14. ARTWORK PRICES AND SALES

Applicants are requested to provide proposed retail prices for works submitted for consideration.

Submission of a proposed price does not by itself establish a binding retail price for the fair.

Final prices, currency, sales procedure, gallery commission, taxes, payment settlement and other commercial conditions applicable to a selected artist will be agreed separately before the presentation.

Any gallery sales commission applicable to the selected artist will be stated in a separate written agreement.

ORAC Gallery does not guarantee the sale of any artwork.

 

15. CHANGES TO PROPOSED WORKS

Selection of an artist does not necessarily mean that every artwork submitted in the application will be exhibited.

ORAC Gallery may work with the selected artist to determine the final selection, number, placement and configuration of works.

Substantial substitutions or changes to selected works require prior agreement with ORAC Gallery.

 

16. WITHDRAWAL BY A SELECTED ARTIST

A selected artist who becomes unable to participate should inform ORAC Gallery immediately.

Where withdrawal occurs after logistical, promotional, transport or other commitments have been made, the consequences will be determined according to the separate agreement concluded with the selected artist and applicable law.

 

17. CHANGES OR CANCELLATION

ORAC Gallery may make reasonable changes to the presentation where required by circumstances outside its reasonable control, including changes affecting the fair, venue, installation conditions, transport, customs, safety or applicable regulations.

If the fair itself is postponed, relocated, materially altered or cancelled, ORAC Gallery will determine the appropriate response taking into account the circumstances and any obligations imposed by the fair organiser.

ORAC Gallery will not be responsible for circumstances outside its reasonable control, subject always to any liability that cannot legally be excluded.

 

18. PERSONAL DATA

Personal data submitted through the application form will be processed for the purposes of administering the Open Call, processing payment, assessing applications, communicating with applicants and, where relevant, organising participation of the selected artist.

Detailed information concerning the processing of personal data is provided in the separate Privacy Notice for the Spectrum Chicago 2026 Open Call.

Consent to retain portfolio and contact information for future exhibition, art fair or curatorial opportunities is optional.

Where that optional consent is given, ORAC Gallery may retain the relevant portfolio and contact information for up to 24 months, subject to the Privacy Notice and the applicant’s right to withdraw consent.

 

19. COMMUNICATION

ORAC Gallery may communicate with applicants using the email address or other contact information provided in the application.

Applicants are responsible for providing valid contact details and monitoring relevant communications during the selection period.

 

20. APPLICABLE LAW

These Terms are governed by Polish law.

Where the applicant is a consumer, this choice of law does not deprive the applicant of mandatory protections that apply under applicable consumer law.

Nothing in these Terms excludes or limits any rights or remedies that cannot legally be excluded or limited.

Any dispute will be subject to the jurisdiction of the courts competent under applicable law.

 

21. FINAL PROVISIONS

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

In the event of a conflict between general ORAC Gallery open-call terms and these Terms, these Spectrum Chicago 2026 Open Call Terms & Conditions prevail in relation to this specific Open Call.

ORAC Gallery may correct obvious typographical or administrative errors in these Terms. Any material change affecting already submitted applications will be communicated where reasonably necessary.
