TERMS & CONDITIONS — ARTIST SUBMISSIONS

1. Organiser
General artist submissions and open calls covered by these Terms & Conditions are organised by:

Certain projects may be organised in collaboration with other partners. Where a particular open call, exhibition, art fair or project has its own dedicated terms, those specific terms take precedence over these general Terms & Conditions.
2. Purpose of Artist Submissions
ORAC Gallery accepts applications from contemporary visual artists interested in exhibition, curatorial, art fair and other professional presentation opportunities.
Submission of an application does not create an obligation for ORAC Gallery to select, represent, exhibit or promote the applicant.
Each application is reviewed individually on the basis of the submitted artistic and professional materials.
3. Application Requirements
Applicants are responsible for providing complete, accurate and up-to-date information.
Depending on the opportunity, applicants may be asked to provide an artist biography, artist statement, CV, portfolio, images and details of artworks, website or professional social media links, pricing information and other materials relevant to the selection process.
Incomplete applications may not be considered.
The applicant confirms that they are the author of the submitted works or are fully authorised to submit them.
4. Application Fee
Unless a specific open call states otherwise, the general application fee is:

The application fee covers the administrative costs of the selection process, formal verification of the application and professional review of the submitted portfolio and materials.
The fee relates solely to the application review service. Payment of the fee does not guarantee selection, exhibition, representation, participation in an art fair, publication, sale of artworks or any other future collaboration.
Payment must be made in accordance with the instructions provided on the relevant application page.
5. Review and Selection
Applications may be assessed on criteria including artistic quality, coherence and maturity of practice, distinctiveness of artistic language, professional readiness, relevance to the particular project and suitability for ORAC Gallery’s curatorial and international programme.
ORAC Gallery may select only those applicants whose work is considered appropriate for a specific opportunity.
The Organiser is not obliged to provide individual feedback or detailed reasons for a selection decision.
6. Selected Artists
Selection for a particular project does not automatically create permanent gallery representation.
If an artist is selected, the practical and commercial conditions of participation may be established separately. These may include, depending on the project, artwork selection, pricing, sales commission, transport, packing, insurance, customs, installation, travel, accommodation, promotion and other logistical matters.
Any material financial obligations beyond the application fee will be communicated separately before the artist commits to the relevant project.
7. Copyright and Submitted Materials
Copyright in submitted artworks remains with the artist or other lawful rights holder.
Submission of an application permits ORAC Gallery to access, store and review the materials for the purposes of the selection process.
Submission alone does not grant ORAC Gallery a general licence to commercially exploit the applicant’s artworks.
Any broader use of images or materials relating to a selected artist, including public promotion of a project, may be agreed separately where appropriate.
8. Generative AI
Where requested in the application, applicants must disclose the use of generative AI in submitted artworks.
Use of AI does not automatically exclude an applicant from consideration. ORAC Gallery may take into account the nature of its use, artistic authorship and the relationship between the technology and the applicant’s artistic practice.
9. Withdrawal and Refunds
Where an applicant is a consumer and statutory consumer protection rules apply, nothing in these Terms limits rights granted by mandatory law.
If the applicant expressly requests that the application review service begin before the expiry of any applicable statutory withdrawal period, review may begin immediately.
If the applicant withdraws after performance of the service has begun but before it has been fully completed, the Organiser may be entitled to payment proportionate to the part of the service already performed, where permitted by applicable law.
Once the application review service has been fully performed following the applicant’s prior express request and acknowledgement, the statutory right of withdrawal may cease to apply to the extent provided by law.
A refund may also be considered in cases of duplicate payment, payment error or cancellation of the application process before the review service has begun.
A negative selection decision in itself does not constitute grounds for a refund once the agreed application review service has been performed.
10. Changes or Cancellation of an Opportunity
ORAC Gallery may modify, postpone or cancel an exhibition, open call, art fair presentation or other opportunity where reasonably necessary due to organisational, curatorial, logistical, legal or circumstances beyond its control.
Where such a change materially affects applicants whose paid application review service has not yet been performed, the Organiser will determine the appropriate next step, including a refund where required by applicable law.
11. Personal Data
Personal data submitted through applications is processed in accordance with the applicable Privacy Policy and relevant data protection law.
Where an applicant separately consents to receiving information about future opportunities, that consent is voluntary and does not affect the assessment of the current application.
12. Governing Law
These Terms & Conditions are governed by Polish law.
Nothing in these Terms deprives consumers of mandatory rights or protections available to them under applicable consumer law.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect.
